What is FoSCoS FSSAI?

FSSAI launched Food Safety Compliance System (FoSCoS) wef 1st June 2020 replacing the existing Food Licensing and Registration System. This system replaces the existing online Food Licensing and Registration System (FLRS: https://foodlicensing.fssai.gov.in ). Users of these States/UTs are now required to visit https://foscos.fssai.gov.in. The technology on which the FLRS was built was outdated with technical support no longer available. Thus the migration from FLRS to FoSCoS was mandatory.

What are the types of FSSAI License

Basic FoSCoS FSSAI Registration

If the annual turnover of a food business is below Rs. 12 lakh then basic registration of food licensing is required. Generally when someone is starting up a business and unsure of expected turnover, basic food safety registration is done which can be upgraded to state license if the turnover exceeds Rs. 12 Lakh.

Dairy having capacity less that 500 liters per day or daily manufacturing capacity less than 100kg per day needs to get basic FSSAI registration which includes wide range of businesses starting from small pan shops, tea stalls, home based food operators, small warehouses, canteen’s , mid day meal services and food processors. The maximum tenure of this license is 5 years and the minimum is 1 year.

State FoSCoS FSSAI License

If the annual turnover of the food business is more than Rs. 12 lakhs and less than Rs. 20 crores then one has to get state FSSAI License.

Manufacturing units having capacity upto 2 MT per day, Dairy units handling business upto 50000 liters per day, 3 star hotels and above, repackers and relebelling units, clubs canteens, all the catering business irrespective of their turnover needs to apply for State licence. The maximum tenure of this license is 5 years and the minimum is 1 year.

Central FoSCoS FSSAI License

If the annual turnover of the food business is more than Rs. 20 Crores then central FSSAI License is required.

Now the businesses which do not fall under the above two categories, they need to go for central licence, the importer and exporters mandatorily needs central licence, in case you are in a business having multiple outlets across the country then you need to go for central licence for your registered address and also need to get basic state or central licences depending on the turnover of each outlet. The maximum tenure of this license is 5 years and the minimum is 1 year.

FSSAI Registration Form

Points to keep in mind while FSSAI license renewal

  • The Food License issued to the FBO will be placed in the Renewal Bin before 120 days of expiry. FBOs need to apply for renewal when their license shows up in the renewal bin.
  • If there is an arising of delay, a punishment of ₹ 100/day will be charged on the Food Business Operator.
  • Non - Renewal of the FSSAI or food license could lead a punishment.
  • The extension of the renewal is also for 1 to 5 years. The cost of renewing will also increase depending on the extension period.

Guidelines on FSSAI License Number

  • The FSSAI logo and FSSAI license number shall be displayed on the label of the food package in contrast colour to the background.
  • In case of multiple units (manufacturer/ packer/ relabeller/ marketer) the FSSAI logo and license number of the brand owner shall be displayed on the label of the food package. The addresses of the multiple units on the label should carry the FSSAI license number.
  • In case of imported food products, the importer shall display FSSAI logo and FSSAI license number along with the name and address of importer. These may either be pre-printed on the label or affixed through a sticker before customs clearance.
  • The height of letters and numeral of license number shall be as prescribed in 2.3.3 of Food Safety and Standards (Packaging and Labeling) Regulation, 2011.
  • The Regulation 2.6.1 of Food Safety and Standards (Packaging and Labeling) Regulations, 2011 shall be applicable to display of FSSAI License number and logo.
  • The display of FSSAI logo on the label of the food product is not a mark of certification but it signifies that the FBO holds a valid license under Food Safety and Standards Act, 2006.

(i) The new regulations / amendments will be made in the FSSAI standards /regulations from time to time and is ongoing process (ii) The regulations / amendments will be placed before the Scientific Panels and Scientific Committee for their opinions / recommendation. (iii) The regulation will be approved by the Food Authority and draft notified after previous approval of Central Government. (iv) The draft notification is also notified to WTO Member Countries for their comments. (v) A time period of normally 60 days is given for information of the persons likely to be affected thereby and sending the comments to the FSSAI. (vi) The comments received on the draft notification are examined by the FSSAI. In case of divergent comments are received on the draft standards / regulations. (vii) The final notification is published in the Gazette of India giving date of effects of its implementation and simultaneously notified to the WTO Member Countries for information & reference.

What are GM foods & organic foods & does FSSAI provides regulations for such type of foods?

GM foods means food and food ingredients composed of or containing genetically modified or engineered organisms obtained through modern biotechnology, or food and food ingredients produced from but not containing genetically modified or engineered organisms obtained through modern biotechnology. The GM foods does not come under the purview of FSSAI. “Organic food” means food products that have been produced in accordance with specified organic production standards.

There are various job as per scope of work. Inspections will be ordered by State/ Central Licensing Authority/ DO. Auditing can also be ordered by respective DOs. However for annual audit/ consultancy, training, FSMS plan etc. have to be handled by agency on the requirement of FBO.

Whether the Food Business Operators are assigned by FSSAI in the place where the Inspection / Certification Body is located or anywhere in India?

Food Safety Commissioner can decide about agencies for their States/areas. FBOs are free to choose as per their requirement.

If more than 1 agency is located at the same place then who will decide which agency will go for the FBO Inspection?

The power lies with the Designated Officer. DO has to decide if he is authorising agency or his FSOs for such inspection.

How many times inspection has to be conducted in a year?

Depends on improvement/ compliance submitted by Agency, DO will decide accordingly. Inspections are to be ordered by DO.
