DIR-3 KYC Application & for KYC of Directors
DIR-3-KYC is a new E-form has launched by the Ministry of Corporate Affairs. This form will be used to update the KYC of all directors.
Certification/ verification of e-form DIR-3 KYC is done under provisions of Companies Act, 2013.
Accordingly, every Director who has been allotted DIN on or before 31st March 2018 and whose DIN is in ‘Approved’ status, would be mandatorily required to file form DIR-3 KYC on or before 31st August 2018. While filing the form, the Unique Personal Mobile Number and Personal Email ID would have to be mandatorily indicated and would be duly verified by One Time Password (OTP). The form should be filed by every Director using his own DSC (Digital Signature Certificate) and should be duly certified by a practicing professional (CA/CS/CMA).
Who has to file DIR-3 KYC?
As per the MCA’s (Ministry of corporate affairs) announcement, all the directors have to file DIR 3 KYC form. Any director who was allotted a DIN by or on 31st of March 2018 and whose DIN is in approved status, will have to submit his KYC details to the MCA by the 31st day of August. Further, this procedure is mandatory for Disqualified directors too.
Directors who have been disqualified by the MCA are required to file DIN eKYC to update their email and phone number on MCA record. Failure to file DIR-3 eKYC form by disqualified Directors will also lead to the additional penalty.
A person is designated partner in LLP such person must have DIN. As such for a person having DIN, it is mandatory for him/ her to file DIR- 3 KYC.
Documents & Information required for DIR-3 KYC
- Self-attested copy of PAN
- Self-attested copy of Passport,/ Voter Id card/ Driving license (if you have a passport)
- Bank Statement / Electricity Bill/ Telephone bill/ Mobile bill (any 1 out of these, but not older than 2 months)
- Passport sized photograph
- Nationality
- Occupation
- Educational qualification details
- Personal Mobile No
- Personal Email Id
What if the Filing is not done?
After the due date filing of DIR-3 KYC in respect of such deactivated DINs shall be allowed upon payment of a specified fee of Rs. 5,000/- only, without prejudice to any other action that may be taken.
In cases when the director who is supposed to file the E - Form does not file it by the 31st of August 2018 on MCA 21 portal, the department will mark the DIN of such director as ‘Deactivated’ with the reason shown as ‘Non-filing of DIR-3 KYC’.
If the director wishes to re-activate his DIN in future by filing the missed out eForm DIR-3 KYC, he can do so only after a specified fee is paid.
Checkpoints while filing DIR-3 KYC
- Personal mobile number (Unique)
- Personal Email Id
- OTP (One time password on Email Id and Mobile number)
- Digital Signature Certificate of Director
- DSC of practicing professional (CA/ CS/ CMA) Chartered Accountant or Company Secretary or Cost and Management Accountant.
It is necessary for the professional to give a declaration that he/ she are engaged in Certification/verification of this e-form. Make sure that the filing is done before specific mentioned date.
