FBO's can Now Migrate From State to Central License and Vice Versa
The FSSAI is established under the Food Safety and Standard ACT, 2006 which is a consolidation statute related to food safety and regulations. FSSAI is responsible for protecting and promoting public health through the regulations and especially the supervision of food safety. FSSAI issues licenses to all the Food Business Operators in the country. Any Food business is required to have a food license in order to run the business.
Depending on the scale of business, it issues three different types of licenses:
- FSSAI Central License
- FSSAI State License
- FSSAI Basic Registration
Once you have your FSSAI license, you may later in the future of your business, want to convert your license. For ex., If you initially have obtained an FSSAI Registration for your small food business, but after a while, you expand your business. If you expand to the point where you become eligible for obtaining an FSSAI State License, then, in this case, you will have to apply for conversion of your fssai food license. According to FSSAI, presently FBOs face problems in migration between state to Central licenses or vice versa as it requires changes in the FSSAI license number.
FBOs were required to surrender their existing license and apply for the new license. The change in FSSAI number results in a change in pre-printed packaging material, stationery, advertisement, and so on, and FBOs get approval from FSSAI HQ by sending applications with the requisite fee for using the pre-printed material of their older license number. This process takes place manually.
FSSAI says that the transition modalities for the modification in the existing license involve a fee which will be calculated at the time of modification based on the number of years left for the term of the license (state or Central) and online module for transfer of authority that includes scrutiny period of 15 days of the filing of the application.
The final decision would be taken by the destined licensing authority under whose jurisdiction the license falls. The approval would be given after scrutiny as per the procedure stipulated under the FSS Licensing and Registration Regulations.
However, in case of rejection of the modification, the license shall continue with the existing licensing authority.
